1. Introduction

1.1 These Terms and Conditions (“Terms”) govern your access to and use of the QueerHub UK website, platform, and related services (the “Platform”).
1.2 QueerHub UK (“we”, “us”, “our”) provides an online marketplace and listings platform where third parties may create, upload, manage, promote, and sell Event Listings, Product Listings, and related services.
1.3 By accessing or using the Platform, whether as a visitor, buyer, organiser, vendor, or account holder (together, “Users”, “you”, “your”), you agree to be bound by these Terms.
1.4 If you do not agree to these Terms, you must not use the Platform.
1.5 These Terms should be read together with our Privacy Policy, Cookie Policy, and any other policies published on the Platform.

2. Our Service

2.1 QueerHub UK operates as a community-focused marketplace and directory platform supporting LGBTQ+ events, products, services, and related offerings.
2.2 The Platform may include, without limitation:

• Event Listings for third-party events, activities, performances, and experiences.
• Product Listings for physical or digital items sold by Vendors.
• External links to third-party websites or ticketing platforms.
• Internal sales functionality for tickets, products, or digital items processed through the Platform.

2.3 Unless expressly stated otherwise, QueerHub UK is not the organiser, promoter, producer, venue operator, supplier, manufacturer, or seller of any listing on the Platform. The relevant Organiser or Vendor is solely responsible for the listing and for fulfilling the applicable contract with the Buyer.
2.4 We provide the marketplace, technical infrastructure, account tools, payment handling arrangements, and related administrative services only.

3. Definitions

3.1 In these Terms:

• “Event Listing” means any listing for an event, activity, performance, gathering, class, experience, or service.
• “Product Listing” means any listing for a physical item, digital item, downloadable item, or other product offered for sale through the Platform.
• “Organiser” means any person or organisation that creates, uploads, promotes, or manages an Event Listing.
• “Vendor” means any person or organisation that creates, uploads, promotes, or manages a Product Listing.
• “Buyer” means any person who purchases tickets, products, digital goods, or other items through the Platform.
• “User” means any person accessing, browsing, registering for, or using the Platform.

4. Eligibility and Accounts

4.1 To create or use an account as an Organiser or Vendor, you must be at least 18 years old and have legal capacity to enter into binding contracts. If you are acting on behalf of an organisation, you must have authority to bind that organisation.
4.2 To make a purchase through the Platform, you must be at least 18 years old or have the consent of a parent or guardian where required by law.
4.3 You must provide accurate, complete, and up-to-date information at all times.
4.4 You are responsible for maintaining the confidentiality of your account login details and for all activity carried out through your account.
4.5 You must notify us immediately if you believe your account has been accessed without authorisation.
4.6 We may suspend or terminate any account where we reasonably believe there has been misuse of the Platform, a breach of these Terms, or unlawful activity.

5. Community Standards and Inclusivity

5.1 QueerHub UK is committed to supporting LGBTQ+ communities, inclusive spaces, and respectful participation across the Platform.
5.2 Users must not upload, publish, promote, or distribute content that is discriminatory, hateful, abusive, harassing, threatening, exploitative, or otherwise harmful to LGBTQ+ people or any protected group.
5.3 We may remove or restrict any listing or account that, in our reasonable opinion, does not align with our community standards, creates a risk to Users, or breaches applicable law.
5.4 Organisers and Vendors are expected to operate their activities, services, and listings in a respectful, inclusive, and lawful manner.

6. Event Listings and Product Listings

6.1 Organisers and Vendors may upload descriptions, images, prices, availability, terms, and related content for their listings.
6.2 Event Listings may relate to physical events, online events, activities, classes, performances, social gatherings, or other experiences.
6.3 Product Listings may relate to physical goods, digital goods, downloadable files, artwork, merchandise, gift items, or other permitted items.
6.4 All listing content must be accurate, lawful, current, and not misleading.
6.5 You must ensure that all images, descriptions, and supporting information used in a listing accurately reflect the item or service offered.
6.6 QueerHub UK may request proof of ownership, authorisation, authenticity, licensing, or compliance at any time.
6.7 We may remove, suspend, or decline any listing at our discretion where we reasonably believe it breaches these Terms, our policies, or applicable law.

7. Marketplace Role

7.1 QueerHub UK provides a marketplace that enables Users to discover, market, and purchase third-party events, products, and services.
7.2 Where a Buyer makes a purchase through the Platform, the contract for the relevant Event or Product is formed directly between the Buyer and the applicable Organiser or Vendor, unless expressly stated otherwise.
7.3 QueerHub UK is not responsible for the quality, performance, legality, suitability, safety, or delivery of any Event, Product, Vendor, Organiser, or related service.
7.4 We do not guarantee that any listing will remain available, unchanged, or in stock at any particular time.

8. Product-Specific Terms

8.1 Vendors are solely responsible for all Product Listings and must ensure that products are lawfully offered, accurately described, and fit for their intended use.
8.2 Vendors must not list counterfeit, prohibited, stolen, unsafe, restricted, or infringing goods.
8.3 Vendors must comply with all applicable laws relating to product safety, consumer rights, distance selling, digital content, labelling, taxation, and returns.
8.4 Vendors must clearly state any relevant product details, including size, colour, format, compatibility, ingredients, limitations, or usage restrictions where applicable.
8.5 Where a Product Listing relates to digital content, the Vendor must ensure the buyer receives lawful access to the digital item in the form and time stated on the listing.
8.6 Vendors must not make claims about a product that they cannot reasonably support or verify.

9. Orders, Tickets and Contract Formation

9.1 Buyers are responsible for reviewing all listing details before completing a purchase, including price, quantity, dates, delivery information, and any restrictions.
9.2 Once a purchase is completed, the relevant order details will normally be shown in the Buyer’s account and/or sent by email.
9.3 The relevant Organiser or Vendor is responsible for fulfilling the order, unless the Platform specifically states otherwise.
9.4 QueerHub UK may act as a marketplace and payment facilitator for transactions completed through the Platform.

10. Fees, Commission and Platform Charges

10.1 QueerHub UK charges a commission fee and a platform fee in connection with the use of the Platform.
10.2 The applicable commission fee and platform fee will be shown in the website information, seller dashboard, or other relevant fee information provided on the Platform.
10.3 Fees may vary depending on the type of listing, the category of seller, the nature of the transaction, or any commercial arrangement agreed with us.
10.4 We may deduct commission fees, platform fees, and any other agreed charges from amounts collected on behalf of Organisers or Vendors before payout.
10.5 Fees may be updated from time to time, but any changes will be communicated or published in advance where reasonably possible.
10.6 Any taxes applicable to fees, listings, sales, or payouts are the responsibility of the relevant Organiser or Vendor unless required otherwise by law.

11. Payment Processing

11.1 Payments made through the Platform are processed by our third-party payment provider, currently Stripe.
11.2 By using the Platform, you agree to comply with any applicable third-party payment provider terms in addition to these Terms.
11.3 QueerHub UK does not store full card details. Payment information is processed securely by the payment provider.
11.4 We may delay, refuse, reverse, or investigate any transaction where we reasonably suspect fraud, abuse, unlawful activity, excessive chargeback risk, or breach of these Terms.
11.5 Payouts are subject to successful payment processing, verification checks, refunds, chargebacks, settlement periods, and any other requirements imposed by our payment provider.

12. Payouts to Organisers and Vendors

12.1 Where applicable, Organisers and Vendors may access a dashboard to view sales and manage payouts.
12.2 Payouts will usually be made after deduction of applicable fees and subject to any refund, reversal, or chargeback risk.
12.3 We may withhold or delay payouts where we reasonably believe there is a risk of fraud, a breach of these Terms, a compliance issue, or a legal obligation to do so.
12.4 Organisers and Vendors are solely responsible for any tax, reporting, or other statutory obligations arising from their sales and payouts.

13. Delivery, Access and Fulfilment

13.1 Organisers and Vendors are responsible for fulfilling the relevant purchase in full and on time.
13.2 For physical products, the Vendor is responsible for packaging, shipping, delivery, and the condition of the item until the point of lawful transfer, in line with applicable law.
13.3 For digital products, the Vendor is responsible for supplying the product or access in the format and within the timeframe stated on the listing.
13.4 For Event Listings, the Organiser is responsible for entry, access, venue arrangements, event changes, cancellations, and performance of the event or activity.
13.5 QueerHub UK is not responsible for late delivery, non-delivery, cancellation, refusal of entry, product defects, or failure to perform by any third party.

14. Refunds, Cancellations and Returns

14.1 Buyers may have statutory rights under applicable UK consumer law, which cannot be excluded by these Terms.
14.2 Unless otherwise stated in the listing or required by law, refunds, exchanges, cancellations, and returns will be handled in accordance with the relevant Organiser’s or Vendor’s stated policy and applicable law.
14.3 Organisers and Vendors must clearly display any refund, cancellation, exchange, or returns policy on their listing.
14.4 If an Event is cancelled or materially changed, the Organiser is responsible for handling any remedy, subject to applicable law.
14.5 If a Product Listing is faulty, misdescribed, not delivered, or otherwise non-compliant, the Vendor is responsible for any remedy required by law.
14.6 QueerHub UK may assist with administration of refunds or disputes where possible, but we are not obliged to issue refunds except where required by law or where the refund relates to a fee charged directly by us.

15. Digital Products

15.1 Digital products may include downloadable content, templates, files, media, digital artwork, online access, or other electronic goods.
15.2 Vendors must ensure digital products are lawful, functional, and correspond with the description provided.
15.3 Unless otherwise stated, digital products are licensed for personal use only and may not be copied, redistributed, resold, or shared without permission.
15.4 Your statutory cancellation rights may be limited once digital content has been downloaded, accessed, or supplied, where permitted by law and clearly disclosed.

16. User Conduct

16.1 Users must not use the Platform to:

• Break any applicable law or regulation.
• Upload or distribute harmful code, spam, or fraudulent material.
• Harass, abuse, intimidate, threaten, or discriminate against others.
• Upload misleading, unlawful, unsafe, or prohibited listings.
• Infringe another person’s rights, including intellectual property rights.
• Attempt to gain unauthorised access to accounts, systems, or data.

16.2 We may suspend or terminate any account or listing where we reasonably believe the User has breached these Terms or poses a risk to the Platform or other Users.

17. Intellectual Property

17.1 All intellectual property rights in the Platform, including its software, layout, branding, design, and QueerHub UK-owned content, are owned by or licensed to us.
17.2 You may not copy, reproduce, modify, distribute, or create derivative works from our Platform content without our prior written permission.
17.3 Organisers and Vendors retain ownership of their own listing content, subject to the licence granted to QueerHub UK under these Terms for the purpose of operating and promoting the Platform.

18. Privacy and Data Protection

18.1 QueerHub UK processes personal data in accordance with applicable data protection laws and our Privacy Policy.
18.2 Organisers and Vendors may also be independent data controllers in relation to Buyer data they receive or use for their own business purposes.
18.3 Organisers and Vendors are responsible for complying with all legal obligations relating to the collection, storage, use, and retention of personal data.
18.4 We may share relevant Buyer information with Organisers or Vendors as necessary to process orders, administer purchases, provide customer support, or comply with legal obligations.

19. Third-Party Links and Services

19.1 The Platform may contain links to third-party websites, external ticketing services, or other external platforms.
19.2 We do not control and are not responsible for third-party websites, products, services, or policies.
19.3 Use of third-party services is at your own risk and may be subject to separate terms and conditions.

20. Disclaimers

20.1 We use reasonable care to maintain the Platform, but we do not guarantee that it will always be available, uninterrupted, secure, or error-free.
20.2 We do not endorse or guarantee any Organiser, Vendor, Event, Product Listing, venue, or third-party service.
20.3 We are not responsible for the acts, omissions, representations, fulfilment, or performance of any third party.
20.4 Any reliance you place on information, listings, or third-party content is at your own risk.

21. Liability

21.1 Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
21.2 Subject to clause 21.1, QueerHub UK will not be liable for indirect, incidental, special, or consequential losses, or for loss of profit, revenue, goodwill, business, or anticipated savings.
21.3 To the maximum extent permitted by law, we will not be liable for losses arising from the conduct of any Organiser, Vendor, Buyer, venue, delivery provider, payment provider, or other third party.
21.4 Our total liability in connection with a particular claim will be limited to the amount of fees paid directly to QueerHub UK in relation to that claim.

22. Indemnity

22.1 Organisers and Vendors agree to indemnify and hold harmless QueerHub UK from and against claims, losses, damages, liabilities, costs, and expenses arising out of or in connection with:

• Their breach of these Terms.
• Their listings, products, events, or services.
• Any claim brought by a Buyer or third party relating to their conduct, goods, services, or content.
• Any infringement of law, regulation, or third-party rights by them.

23. Changes to These Terms

23.1 We may update these Terms from time to time.
23.2 The updated version will be posted on the Platform with a revised date.
23.3 Where changes are material, we will take reasonable steps to notify Users.
23.4 Continued use of the Platform after the updated Terms take effect means you accept them.

24. Suspension and Termination

24.1 We may suspend or terminate any account, listing, or access to the Platform where we reasonably believe:

• These Terms have been breached.
• Fraud, abuse, or unlawful activity may be involved.
• A listing presents legal, reputational, operational, or safety concerns.
• We are required to do so by law, regulation, or a competent authority.

24.2 Termination does not affect any rights or obligations that arose before termination, including payment obligations, liabilities, or indemnities.

25. Governing Law

25.1 These Terms and any dispute or claim arising out of or in connection with them or the Platform are governed by the laws of England and Wales.
25.2 The courts of England and Wales will have exclusive jurisdiction over any dispute, except where consumer law provides otherwise.
